1. SoulGen Overview
SoulGen is an online picture-generating application that employs artificial intelligence algorithms to create unique content (“Services”). Some features within the APP may require you to create a user account.
To use SoulGen, you input text describing the image in your imagination, select or upload features about the picture, and our artificial intelligence algorithms generate a picture based on your settings.
By downloading, updating, accessing, and/or using the APP, you agree to be bound by this TOS. Your access or use of the APP signifies acceptance of both the TOS and our Privacy Policy. If you disagree with these terms, please refrain from further use of our APP, and you will be unable to access any part of our Services.
2. Account
2.1. Parts of the Services may require you to create a user account, email, ID, and/or password (“Protected Areas”). You agree to access the Protected Areas only using your registered user account and/or ID and password.
- You can sign in with email or log in with Google as a third-party.
- You represent and warrant that all information submitted to create a user account is true, correct, and that you have the right to submit such information.
- You agree to update your account information as necessary to ensure it remains current, accurate, and correct.
- You are responsible for maintaining the confidentiality of your user ID and password, and you agree not to share or disclose them to any third party.
- Your user account and user ID are non-transferable.
Violation of these terms may lead to the cancellation of your user account at our discretion.
1.2. Subscription
We retain the right to provide certain Services, available only for paid subscribers. Subscription begins after the initial payment, and you are responsible for all associated fees and taxes.
- You can cancel the subscription in your PayPal account or through SoulGen’s Feedback Form.
- Refunds are possible only if no images have been generated. If an image is generated before requesting a refund, a dispute may be initiated.
- Only regular-priced items are eligible for refunds.
- We are not responsible for costs or liability if the APP is downloaded or subscribed to from an unrecognized distribution platform.
3. Legal Capacity
You warrant that you are authorized to enter this TOS, of legal age, or accessing the APP under parental supervision. You are not barred from using the APP under the laws of Hong Kong Special Administrative Region (HKSAR) or other applicable jurisdictions.
4. Intellectual Property
The intellectual property in the APP and embedded materials are owned by or licensed to us. You may download the APP for personal use, and this license terminates upon violation of these terms.
5. Your Contents
You retain ownership of content submitted to us but grant us a license to use it. The license is terminable by deleting your content or account.
6. Conduct and Content Restrictions
In using the APP, you agree to various rules, including refraining from modifying the APP, interfering with security features, and not uploading objectionable content. We reserve the right to reject or remove user content that violates these provisions.
7. Claims of Infringement
If you believe materials in the APP infringe your copyright or other rights, please follow the procedures outlined in this section.
8. Liability
The APP is provided on an “as-is” basis, and we disclaim any warranties to the fullest extent permissible by law. We are not liable for damages arising from APP use.
9. Links to Third-Party Websites and Services
The APP may include links to third-party websites and services. We assume no responsibility for any damage or loss resulting from the use of third-party content.
10. Governing Law; Dispute Resolution
This TOS is governed by the laws of HKSAR. Any dispute will be resolved in the courts of HKSAR.
11. Changes to this TOS
We reserve the right to update the TOS, and your continued use after changes means acceptance of the revised terms.
12. Termination; Assignment
This TOS continues until terminated. We reserve the right to assign or transfer the Services. Notice of assignment will be posted on the APP.
13. Miscellaneous
If any provision is found unenforceable, it will not affect the validity of remaining provisions. This TOS, together with the Privacy Policy, constitutes the entire agreement.
